OWN Financial Terms of Use
The agreement
These Terms of Use apply to your access to and use of the websites, mobile applications, dashboards, tools, reports, educational content, communications and related services operated by OWN Financial Inc. and its affiliates, subsidiaries, successors or assigns, as applicable, collectively referred to as "OWN," "we," "us" or "our."
In these Terms, "Services" means the OWN website, app, dashboards, account tools, financial-intelligence features, educational content, document-upload tools, integrations, reports, communications and any other product or service we make available that links to these Terms.
"You" means the person accessing or using the Services. If you use the Services on behalf of another person, household, company, trust, estate or other organization, you represent that you have the legal authority to do so and to bind that person or organization to these Terms.
By accessing or using the Services, creating an account, connecting an external account, uploading information, downloading a report or otherwise interacting with OWN, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must stop using the Services.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, which may include posting the updated Terms, updating the "Last updated" date, sending a notice or presenting the updated Terms when you next use the Services. Your continued use of the Services after the updated Terms become effective means you accept them.
OWN is a financial organization, education and intelligence platform. We help users understand their household finances by organizing information, displaying charts and dashboards, identifying patterns, explaining concepts and showing possible planning opportunities. Unless we expressly state otherwise in a separate written agreement:
- OWN is not your investment adviser, portfolio manager, securities dealer, insurance broker, insurance adviser, mortgage broker, tax preparer, accountant, lawyer, estate planner or financial planner.
- The Services do not create a fiduciary, advisory, professional-client, solicitor-client, accountant-client, broker-client or agency relationship.
- The Services are not an offer to sell, a solicitation to buy or a recommendation to buy, sell, hold, borrow, lend, insure, invest, contribute, withdraw or otherwise transact in any security, insurance product, credit product, deposit product, benefit program or financial product.
- The Services do not replace independent professional advice.
Any content, dashboard, projection, score, insight, explanation, checklist, comparison, scenario, benefit estimate, tax estimate, insurance estimate, investment illustration, estate illustration or similar output is provided for general informational and educational purposes only.
OWN may use information you provide or connect to generate dashboards, insights, scenarios and educational explanations. Even where information appears tailored to you, unless we expressly agree otherwise in writing, it is not professional advice. You should consult qualified professionals before acting on matters involving:
- investments or securities;
- tax filings, deductions, credits, benefits or tax planning;
- estate planning, wills, powers of attorney, trusts or beneficiary designations;
- insurance coverage or claims;
- mortgages, loans, credit or debt;
- pensions, registered accounts or government benefits;
- legal rights, obligations or disputes;
- any financial decision that could materially affect you, your household, your company or your estate.
You are responsible for evaluating whether any information or output from the Services is appropriate for your circumstances.
Your account & data
To use certain Services, you may need to create an account. You agree to provide accurate, current and complete information and to update it when necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must notify us promptly if you believe your account has been compromised or used without authorization. We may refuse, suspend or terminate access if we reasonably believe that information is inaccurate, that your account is being misused, or that continued access could create legal, security, regulatory, operational or reputational risk.
OWN may allow you to include information about household members, family members, dependants, beneficiaries, companies, trusts, properties, accounts or other third parties. You agree that you will only provide, upload, connect or use information about another person or entity if you have the authority or consent to do so, and that any information you provide about others is accurate and lawful to use.
You must not use OWN to access, monitor, analyze or make decisions about another person's finances without proper authority.
OWN may allow you to connect external accounts or import information from banks, credit card issuers, brokerages, payroll providers, tax documents, government notices, credit bureaus, benefits portals, property records, insurance records or other third-party sources. When you connect or import information, you authorize OWN and our service providers to access, collect, process and display that information for the purposes described in the Services and in our Privacy Policy.
Third-party information may be incomplete, delayed, incorrect, duplicated, miscategorized or unavailable. We do not control third-party systems and are not responsible for errors, outages, delays, changes, fees, account restrictions or other issues caused by third parties. You are responsible for reviewing connected information and correcting or updating it where necessary.
The Services may allow you to upload documents such as notices of assessment, pay stubs, account statements, insurance policies, wills, powers of attorney, mortgage documents, tax slips or other records. You are responsible for ensuring that you have the right to upload those documents and that they do not contain information you are not authorized to share.
OWN may use automated tools, including document-reading technology and artificial intelligence, to extract, summarize, classify or analyze information from uploaded documents. These tools can make mistakes. You should review any extracted information, summary or output before relying on it. Do not upload documents containing information that is unlawful, fraudulent, malicious, defamatory, infringing or unrelated to your authorized use of the Services.
Intelligence & outputs
OWN may use automated systems, machine learning, artificial intelligence or similar tools to help generate summaries, classifications, projections, explanations, alerts, recommendations for further review, educational content and other outputs.
AI-assisted outputs may be inaccurate, incomplete, outdated or inappropriate for your specific circumstances. They may also reflect assumptions, limitations or errors in the data available to the system. You agree that AI-assisted outputs are decision-support tools only. They do not replace human judgment or professional advice.
The Services may include projections, estimates, simulations or scenarios relating to net worth, retirement, savings, investments, tax, insurance, government benefits, property, debt, estate planning, cash flow or other financial matters. These outputs are based on assumptions, available information and mathematical models.
Actual outcomes may differ materially due to market performance, interest rates, inflation, tax changes, government policy, account fees, product terms, personal circumstances, employment changes, family changes, health, life expectancy, legal changes and other factors. No projection, forecast, chart or scenario is a promise, guarantee or prediction of future results.
OWN may publish articles, guides, explainers, checklists, videos, dashboards, calculators, glossaries, comparison tools and other educational content. We aim to make content clear, useful and accurate at the time it is prepared.
However, laws, rates, rules, product terms, market conditions and government programs change. Content may become outdated or may not apply to your province, territory, country, household, tax status, legal status or financial situation. You should verify important information before acting on it.
Third parties & fees
OWN may display or link to third-party websites, products, providers, platforms, tools, offers, accounts, insurance products, investment products, credit products, government programs, professional advisers or other resources. Unless we clearly state otherwise, third-party links and references are provided for convenience and information only. They do not mean that OWN endorses, controls, guarantees or is responsible for the third party, its content, security, privacy practices, products, services, fees, eligibility rules or decisions.
OWN does not currently receive compensation, referral fees or affiliate revenue from third parties. If that ever changes, we will disclose the arrangement at the point where it could affect what you see, before you act on it. You are responsible for reviewing any third-party terms, privacy policies, fees, risks and eligibility requirements before using a third-party product or service.
Some Services may be free. Others may require payment, subscription fees or other charges. If fees apply, we will disclose them before charging you. You agree to pay applicable fees, taxes and charges for paid Services you purchase or subscribe to.
We may change fees or introduce new fees by providing reasonable notice where required. Unless otherwise stated, fees are non-refundable except as required by law or as expressly provided in the applicable offer terms.
Rules & rights
You agree not to misuse the Services. You must not:
- violate any law, regulation, court order or third-party right;
- use the Services for fraud, deception, harassment, surveillance, discrimination or unlawful activity;
- access or use another person's account without authorization;
- upload viruses, malware, harmful code or malicious content;
- interfere with the security, availability, integrity or performance of the Services;
- attempt to bypass security, authentication, rate limits or access controls;
- scrape, crawl, copy, mirror, frame, data-mine or harvest the Services or their content without our written permission;
- reverse engineer, decompile, disassemble or attempt to extract source code, models, systems, prompts or underlying technology except where permitted by law;
- use automated tools to access the Services in a way that may burden or disrupt them;
- misrepresent your identity, affiliation, authority or financial circumstances;
- use the Services to develop or train a competing product without our written permission;
- remove copyright, trademark or proprietary notices;
- encourage or assist anyone else to do any of the above.
The Services, including their design, dashboards, charts, interfaces, graphics, text, educational content, software, code, models, workflows, templates, trademarks, logos, trade names and other materials, are owned by OWN or our licensors and are protected by copyright, trademark and other intellectual property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Services for your own lawful personal or internal household purposes. You may not copy, reproduce, publish, distribute, sell, license, modify, create derivative works from or commercially exploit the Services or any OWN content except as expressly permitted by us in writing.
You retain ownership of information, documents, data and content you provide to OWN, subject to the rights you grant us under these Terms and our Privacy Policy.
You grant OWN and our service providers a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit, display, analyze, classify, extract, format, modify and use your content and information as reasonably necessary to provide, secure, improve and support the Services, comply with law and exercise our rights under these Terms. You represent that you have the rights necessary to provide your content and information to OWN.
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, disclose, retain and protect personal information.
We use administrative, technical and physical safeguards designed to protect information. However, no system, network, transmission or storage method is completely secure. We cannot guarantee that information transmitted to or stored by OWN will be perfectly secure or immune from unauthorized access, loss, misuse or alteration. You are responsible for using secure devices, protecting your login credentials, enabling available security features and promptly notifying us of suspected unauthorized access.
Service & liability
We may modify, suspend, restrict, replace, discontinue or remove any part of the Services at any time, with or without notice, subject to applicable law. The Services may be unavailable from time to time due to maintenance, updates, system failures, third-party outages, security incidents, force majeure events or other reasons.
We are not responsible for losses arising from the unavailability, interruption, delay, modification or discontinuance of the Services, except where liability cannot be excluded by law.
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, OWN disclaims all representations, warranties and conditions of any kind, whether express, implied, statutory or collateral, including warranties or conditions of accuracy, completeness, timeliness, reliability, availability, security, merchantability, fitness for a particular purpose, title, non-infringement, performance, durability and error-free operation. Without limiting the above, OWN does not represent, warrant or guarantee that:
- the Services will be uninterrupted, secure, current, complete or error-free;
- any content, insight, calculation, projection, classification or output will be accurate or suitable for your circumstances;
- defects will be corrected;
- the Services will meet your expectations or produce any particular result;
- third-party data, products, links or services will be accurate, available or appropriate;
- any financial, tax, legal, insurance, investment, credit, estate or benefits outcome will be achieved.
Some laws do not allow limitations on implied warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, OWN and its affiliates, directors, officers, employees, contractors, agents, service providers and licensors will not be liable for any indirect, incidental, special, consequential, aggravated, exemplary or punitive damages, or for any loss of profits, revenue, business, opportunity, goodwill, data, use, savings, investment return or anticipated benefit, whether based in contract, tort, negligence, strict liability or any other legal theory.
To the fullest extent permitted by law, OWN's total aggregate liability for all claims arising out of or relating to the Services or these Terms will be limited to the greater of: (a) the amount you paid to OWN for the Services giving rise to the claim in the twelve months before the claim arose; and (b) CAD $100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You agree to indemnify and hold harmless OWN and its affiliates, directors, officers, employees, contractors, agents, service providers and licensors from and against any claims, proceedings, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising from or relating to:
- your use or misuse of the Services;
- your breach of these Terms;
- your violation of law or third-party rights;
- information, documents or content you provide, upload or connect;
- your use of the Services on behalf of another person or entity without proper authority;
- decisions or actions you take based on the Services.
We may suspend, restrict or terminate your access to the Services at any time if we reasonably believe that: you have breached these Terms; your account has been compromised; your use creates legal, regulatory, security, operational or reputational risk; we are required to do so by law, court order, regulator, law-enforcement request or third-party provider; or the Services are being discontinued.
You may stop using the Services at any time. Certain provisions of these Terms will continue to apply after termination, including provisions relating to ownership, disclaimers, limitation of liability, indemnity, governing law and dispute resolution.
Legal & contact
You agree that OWN may communicate with you electronically, including by email, in-app notices, website notices, push notifications or other electronic methods. Electronic communications may include legal notices, service notices, security alerts, account information, updates and other messages related to the Services. You are responsible for keeping your contact information current.
If you access the Services through a mobile application downloaded from an app store, additional terms from Apple, Google or another app store provider may apply. Those providers are not responsible for the Services except as required under their applicable terms or law.
If you provide ideas, suggestions, comments or feedback about OWN or the Services, you agree that we may use them without restriction or compensation to you. You waive any moral rights you may have in that feedback to the extent permitted by law.
These Terms may be made available in English and French. If there is a conflict between versions, the English version will govern unless applicable law requires otherwise. A French-language version is being prepared for users in Québec and elsewhere in Canada.
If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later. Any waiver must be in writing and signed by us.
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction or by operation of law.
These Terms and your use of the Services are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
Subject to any rights you may have under applicable consumer-protection law, you agree that the courts located in Toronto, Ontario will have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services.
